The Menstrual Dignity Act at Nyssa School District

The Menstrual Dignity Act (HB 3294, 2021) created the requirement for school districts to provide free menstrual products for all menstruating students in public schools in Oregon, including elementary, middle, and high school students. This legislation created the Menstrual Dignity for Students Program. The four pillars of this program focus on privacy, inclusivity, access and education.

The Oregon State Board of Education passed additional Oregon Administrative Rules (OARs) in March of 2022 requiring menstrual products be available in all student bathrooms.  The following plan has been implemented at Nyssa School District:

1.       Each multi-stall bathroom at the elementary, middle and high schools have containers with products available. In addition to the regular multi – stall bathrooms at each school we have installed additional containers at the elementary in the nurse’s office bathroom. At the middle school, the gender-neutral bathroom and the gym locker rooms have containers and products available. At the high school, the gym locker rooms also have containers with products available.

2.       All containers are labeled as free products in English and Spanish.

3.       Containers were installed with thought to discreet access and student privacy.

4.       Each container holds tampons and pads.

5.       Appropriate trash receptacles have been placed in all locations of product containers. Trash receptacles are accessible privately within a stall.

6.       Students have ongoing access to products at each school throughout the school day. Restrooms are cleaned in a rotation that allow full access to an open restroom containing products.

7.       Signs are posted for student product knowledge and appropriate use.

8.       NSD is working with the company Aunt Flow to obtain required materials. They also provide education tools if families are interested.

9.       Containers are placed at an average height for the age group in which the restroom is located; keeping ADA needs in mind. If your student has needs that would make reaching the container not suitable for them, please communicate with the District Health Coordinator.

10.   Each school bus will maintain a small number of pads and tampons to have available to students when on field trips or off campus for extracurricular activities.

11.   After regular school hours and during school events including sporting events and extracurricular activities where students will be on campus, students will have access to products in the bathrooms designated for each event.

12.   If parents have questions about available products or how to obtain products for their student, please contact the District Health Coordinator.

If parents or guardians have questions or concerns about the state program, Menstrual Dignity for Students Program, please visit the Oregon Department of Education website or email ode.menstrual-dignity@state.or.us.
